What is the Difference Between Chapter 7 and Chapter 13 Bankruptcy?

There are two main types of bankruptcy for individuals: Chapter 7 bankruptcy and Chapter 13 bankruptcy. Chapter 7 is commonly referred to as 鈥渓iquidation鈥 bankruptcy because you can cancel many (or all) your debts and not pay back your creditors. The Chapter 7 bankruptcy process takes approximately four to six months.

To qualify for Chapter 7, you must pass the 鈥渕eans test.鈥 You pass the test if your household income is lower than New York鈥檚 median household income. If you do not pass the test, you may qualify for Chapter 13.

Chapter 13 bankruptcy is meant for debtors with a regular income and the ability to pay back some of their debts through a repayment plan. The amount you must repay is based on your income, expenses, and all other types of debt. The process of this type of bankruptcy takes three to five years.
